CONDITIONS OF SALE

1. PRICES
Prices are continually fluctuating and are subject to alteration without notice. All Prices quoted are subject to price variation as follows: All prices are based on the cost of material, labour, transport, and of conforming to statutory obligations ruling at the date of tender, and if between that date and the date on which the goods are despatched by us variations either by rise or fall, shall occur in these costs, then the price shall be amended to provide for these variations. All goods will be invoiced at the prices ruling on the date of despatch.

2. OPENING ACCOUNTS
Customers desirous of opening a credit account are requested to furnish two trade and one Bankers Reference. Where no credit account has been opened cash with order will avoid delay in despatch.

3. QUOTATIONS
All quotations are given at current prices, but subject to alteration in accordance with prices ruling at time of delivery.

4. CARRIAGES
We normally make no charge for delivery from our own warehouse, within our van delivery area, but reserve the right to charge carriage on deliveries outside our usual delivery area. Where goods are specially ordered from works and a carriage charge is made, we reserve the right to pass on this charge.

5. GUARANTEE
We can give no guarantee on goods supplied by us, other than that given by the manufacturers concerned, but will do everything within our power to protect our customers interests. We do not accept liability for any consequential damage arising from goods supplied by us.

6. MANUFACTURER`S TERMS
All the above conditions are general, but manufacturers terms of business will apply where they differ in any respect, and acceptance of such goods constitutes an acceptance of such conditions. Goods specially made cannot be cancelled without our written sanction.

7. RETURNS
Goods correctly supplied may not be returned without our written agreement. Goods so returned must be consigned Carriage Paid and accompanied by a Packing Note stating our Delivery Note Number. In some instances a restocking charge maybe made.

8. PACKING AND TRANSIT Boxes and cases that have been charged will be credited in full if returned in good condition, carriage paid and within 14 days from date of our invoice. Cable drums are charged in accordance with makers drum schedules. Goods received damaged should be signed for as “Damaged”. Customers are asked to note the prescribed periods for notification of damage to, or shortage and non-delivery of goods, and the submission of claims in respect thereof, and will hold ourselves indemnified from any losses resulting from Customers failure to comply with the requirements of the Railways, Road Companies and GPO Regulations. All R.I.B.A. conditions excluded.

9. ORDERS Written confirmation of telephoned orders should be clearly marked as such, otherwise we cannot be responsible should the order be duplicated. The right is reserved to refuse cancellation of any order placed, or to suspend delivery of any order from time to time, if any account is in arrears.

10. RETENTION OF TITLE It is agreed that title to the goods shown on this Invoice, Order, Advice Note etc shall not pass to the buyer until payment in full has been made to the seller in respect thereof and that until title shall pass the buyer has the goods in his possession and at his risk solely as bailee for the seller and such bailment shall be deemed to terminate forthwith if the buyer, being an individual, commits an Act of Bankruptcy or being a company enters into liquidation or has a petition presented or has a Receiver appointed, or in either case allows distress to be levied against his property, whereupon the seller shall be entitled to resume immediate possession of the goods, for which purpose the buyer grants to the seller an unrestricted right of access to and entry upon any premises in which said goods may from time to time be situated. If the buyer disposes of the goods before title passes to him, he shall be deemed to do so as agent for the seller and shall hold the proceeds of sale in trust for the seller, and the buyer hereby assigns to the seller all his rights and claims against the sub-purchaser
